(1) In any prosecution for an offense described in section 712-1223, 712-1224, 712-1225 or 712-1226, a defendant may assert the affirmative defense that the gambling activity in question was a social gambling game as defined in section 712-1231(a). For more on that, see this article, 'Assessing liability of social networking sites,' by lawyer Joseph V. DeMarco, published last fall in the law journal World Online Gambling Law Report (fee.

Counties and cities may, by ordinance, authorize the playing or conducting of a social game in a private business, private club or in a place of public accommodation. Such ordinances may provide for regulation or licensing of the social games authorized. [1974 c.7 §3]

Note: 167.121 (Local authorization of social games) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 167 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
